WHAT IS THE STEVEN D. GERTLER & ASSOCIATES, LTD. ONLINE PAYMENT SYSTEM? Steven D. Gertler & Associates Ltd. uses Integrity Payment System, LLC online payment system at no cost, a web-based system that allows account users with accounts serviced by Steven D. Gertler & Associates, Ltd. to authorize a one-time or multiple funds transfer from their credit card or debt card for the purpose of making a payment to your account on the date and in the amount specified by the user. The payment is directly authorized by Steven D. Gertler & Associates, Ltd. online payment system user based upon certain information provided to the firm by the user. NOTICE Steven D. Gertler & Associates, Ltd. requires that all users of the online payment system adhere to the following terms and conditions for the use of the online payment system. Please read the following information carefully. By authorizing payment to Steven D. Gertler & Associates, Ltd. via the Integrity Payment System, LLC online payment system you expressly acknowledge and accept all of the following terms and conditions of use. If you do not agree to be bound by the terms and conditions of use, please immediately exit the Steven D. Gertler & Associates Ltd. online payment system. Our firm is acting as a collection agent for our client. Federal Law requires us to inform you that any information obtained during the online payment system process may be used for that purpose. USER LIABILITY If you believe that someone effectuated payment on your account from your FUNDING ACCOUNT via the Steven D. Gertler & Associates, Ltd. online payment services without your permission, you are required to contact Steven D. Gertler & Associates, Ltd. within two business days after you learn of the unauthorized transfer. Your failure to notify Steven D. Gertler & Associates, Ltd. within this time frame may increase your liability for the unauthorized transfer to as much as $500.00. Similarly, after reviewing your statement for your FUNDING ACCOUNT, if you discover unauthorized transfer(s) for your account, you are required to notify Steven D. Gertler & Associates, Ltd. of the unauthorized transfer(s) within 60 days after the statement was mailed to you. Your failure to so notify the firm within this time frame may increase your liability to the full amount of the transfer(s) after the 60 days. YOU REMAIN RESPONSIBLE FOR THE TIMELY PAYMENT OF YOUR DEBT REGARDLESS OF YOUR USE OF THE STEVEN D. GERTLER & ASSOCIATES, LTD. ONLINE PAYMENT SYSTEM OR TRADITIONAL PAYMENT METHODS. IT IS SOLELY YOUR RESPONSIBILITY TO MONITOR YOUR ACCOUNT SERVICED BY OUR ONLINE PAYMENT PLAN AS WELL AS YOUR FUNDING ACCOUNT FOR THE PURPOSE OF MAKING SURE TIMELY PAYMENT WAS MADE ON YOUR ACCOUNT WITH OUR FIRM. TERMINATION OF USE By using the Steven D. Gertler & Associates, Ltd. online payment system and entering this site, you agree that your access to the online payment system may be immediately suspended : (1) if you do not agree to these Terms and Conditions of Use; (2) your use at anytime violates any of these Terms and Conditions of Use; or (3) your use results in 0 or more payments being returned for non-sufficient, insufficient, cancelled, stop-payment, or similar designations.
CONFIDENTIALITY Steven D. Gertler & Associates, Ltd. will disclose the information you provide about your FUNDING ACCOUNT, transfer(s) you authorize via the online payment system, and in support of your authorization for the Steven D. Gertler & Associates, Ltd. online payment system transfer to third parties under the following circumstances: 1) where it is necessary for completing a transfer, 2) in order to comply with criminal justice agencies requests, subpoenas, lawful discovery under federal or state rules of civil and criminal procedure or court orders and, 3) if you give written permission to do so. SECURITY The security of the information you provide to facilitate your Steven D. Gertler & Associates, Ltd. online payment system transfer is very important to our firm. Steven D. Gertler & Associates, Ltd. requires that prior to initiating the online payment system transfer that a secure session first be established using Secure Socket Layer (SSL) technology. During a secure SSL session, your computer exchanges key information with Steven D. Gertler & Associates computers to create a private conversation that only your computer and Steven D. Gertler & Associates, Ltd. systems may understand. CAPTURE AND RETENTION OF FUNDING ACCOUNT INFORMATION Users hereby agree that if and when the user authorizes Steven D. Gertler & Associates, Ltd. to retain the users credit account number for use in future payment authorizations, that the user will completely shut down and exit from the Steven D. Gertler & Associates, Ltd. online payment system and website after authorizing payments via the online payment system to prevent the inadvertent use and/or theft of the stored information by unauthorized third parties. Please note that this information will be viewable by third parties with access to your account if any third parties access the online payment system. User agrees to indemnify and hold Steven D. Gertler & Associates, Ltd. harmless from any and all damages or harm resulting from the unauthorized access to the users bank/financial account number resulting from the users failure to comply with this or any other sections of the online payment system Terms and Conditions of Use. USING THE STEVEN D. GERTLER & ASSOCIATES, LTD. ONLINE PAYMENT SYSTEM Users may not authorize a Steven D. Gertler & Associates, Ltd. online payment system transfer to be effective on weekends. You can obtain confirmation of your Steven D. Gertler & Associates, Ltd. online payment system transfer after authorizing the transfer. The Steven D. Gertler & Associates, Ltd. online payment system enables you to preauthorize transfers and as such you have a right to cancel or revoke the authorization until 3 business days or more before the transfer is scheduled to be made. In the event you desire to cancel or revoke the authorization for student loan payment via transfer from your FUNDING ACCOUNT, you are able to delete pending requests through the View Payment Activity link in the Steven D.
